The British North America Act actually required a country wishing to federate with Canada to be solicited by the parliament of the country but the British decided to overlook this provision of the law in order to complete the process. This dates back to the British North America Act [section 91(24)]; but when you consult this, it says that the federal government is responsible for Indians and lands reserved for Indians. The British North America Act gave the federal government most of the power, with the provinces having defined limited powers. |
