In lieu of the CTO reporting solely to the CFO, other viable alternatives include reporting to the corporate legal functions and the internal auditor or audit committee. However, the Legislature intended CTO law to be difficult to comply with because CTO is a form of compensation deferral that is inconsistent with basic labor rules that require employers to pay employees for work in regular payrolls when or shortly after the work is done.
