In response, in the final rule, we allow claimants to submit statements to the DRB whenever the DRB notifies a claimant that it will review his or her claim. Our primary design was enthusiastically supported by DRB and the heads of the homeowners associations. The court further ruled that because the subcontractor had no right to participate in the selection of the Dispute Resolution Board panel, the panel was presumptively biased against the subcontractor and therefore the subcontractor was not required to submit its claim to the DRB. |
