Oregon law allows use of deadly force if a person reasonably believes that another person is committing a felony involving the use or imminent use of physical force or that another person is unlawfully using deadly physical force against a third person. On April 29th, a Marion County grand jury cleared the homeowner, concluding that he was indeed justified in using deadly physical force under Oregon law, which requires that at least one of three criteria be met: The person employing deadly force must reasonably believe that the other person is burglarizing or attempting to burglarize a dwelling, is using or about to use unlawful deadly physical force against someone, or is attempting to commit arson. A policeman then "used deadly physical force reasonably believing that his life and the lives of the other officers were endangered. |
