A 20-year-old woman who said she was sexually assaulted by a detention officer at Central Juvenile Hall should receive a $321,520 settlement, despite a lack of evidence to file criminal charges, the county Claims Board recommended Monday. The court held that summary judgment for a detention officer was precluded by a genuine issue of material fact as to whether the officer acted with deliberate indifference when she did not ensure that the detainee was taken to an emergency room following a display of abnormal behavior after he suffered a serious head or brain injury following a blow. She filed suit against the INS, claiming that the agency was negligent in supervising and retaining Kendalla as a detention officer. |
