Considered the most comprehensive international treaty on the rights of persons with disabilities--and only the fourth major human rights treaty ever adopted by the United States and the first during the twenty-first century--the convention obligates ratifying countries (140 since May 2008) "to prevent discrimination against, promote accessibility for, and work to achieve the full realization of economic, social, and cultural rights for persons with disabilities.
While economic, social, and cultural rights are subject to a country's maximum available resources and the principle of progressive realization, international human rights law's prohibition on discrimination is not.
Countries with planned economies argued that the need for survival superseded the aspiration to freedom, so that access to basic necessities included in the basket of economic, social, and cultural rights should take priority in policy and practice.
