In evaluating alleged special factors, courts have traditionally looked to similar provisions of the Equal Access to Justice Act (
Subtitle C amends the Equal Access to Justice Act and allows small business to recover legal fees or costs resulting from an agency demand determined to be unjustifiably unreasonable or excessive.
A sampling of these legal triumphs include: the Prompt Pay Act of 1982, the Small Business Innovation and Research Pro ram Reauthorization Act, the Equal Access to Justice Act and the Minority Business Opportunity Reform Act.
