In deciding two similar cases on appeal, the court ruled FCRA requires an adverse action notice be sent whenever a higher rate is charged because of credit information--including when the policy is initially written or when it is renewed.
Section 411 of the Fair and Accurate Credit Transactions Act of 2003 (FACT Act) amended the FCRA to provide that a creditor may not obtain or use medical information in connection with any determination of a consumer's eligibility, or continued eligibility, for credit except as permitted by regulations or the FACT Act.
FACTA, which was enacted on December 4, 2003, amends the FCRA and directs the FTC, the Federal Reserve Board, the Office of the Comptroller of the Currency, the Federal Deposit Insurance Corp.
