The FNHAA recently introduced in Congress encapsulates much of the country's current disgust with compelling arbitration agreements in cases in which a nursing home resident has been severely harmed by the failure of the facility to provide adequate care.
It should be noted that, if the FNHAA were to pass, it would likely preempt all state laws on the issue and thus may eliminate the need for Missouri to amend its laws.
