The 2008 Notice indicates on a preliminary basis that FOIR proposes to make a finding, following its review of data submitted by AmCOMP on June 22, 2007, for accident years 2003, 2004 and 2005, that "Florida excessive profits" (as defined in Florida Statute Section 627.
The Notice (filed on May 19, 2008, and described in the Company's Current Report on Form 8-K, dated May 23, 2008) indicated that FOIR had made a preliminary finding that AmCOMP had realized excessive profit in the amount of approximately $11.
The order from FOIR instructs CSH to provide its home healthcare policyholders with three options: 1) retain their current policy with a 50% rate increase, 2) exchange their current policy for a replacement policy with a reduced benefits package and a 25% rate increase, or 3) exchange their current policy for a contingent benefit, equal to 100% of the sum of all premiums paid.
