Under the Federal Food, Drug and Cosmetic Act (FD&C Act) of 1938, it is a crime to market unsafe cosmetic products. One document, entitled: "Post-marketing Adverse Event Reporting for Non-prescription Human Drug Products Marketed without an Approved Application," implements amendments passed in 2006 to the Food, Drug and Cosmetic Act [FDCA], which requires FDA to "add safety reporting requirements for OTC drug products that are marketed without an approved application. |
