In light of this decision, the IRS subsequently issued this notice, which provides that such cases should not be settled; instead, a motion to dismiss should be filed. Circuit Court Judge Gene Schnelz has granted Steel Dynamics' motion to dismiss GM's lawsuit on the basis that GM failed to state a legally valid claim against SDI in its suit, filed earlier this year. According to the court, the issue of whether legitimate penological interests existed for interference with the prisoner's outgoing mail could not be resolved at the motion to dismiss phase. |
