Competitive local exchange carrier New England Voice and Data (NEVD) announced today that Rhode Island's Public Utilities Commission (PUC) ruled in its favor in its claim for reciprocal compensation, requiring Bell Atlantic to pay NEVD for Internet traffic originated by Bell Atlantic's subscribers.
The PUC's decision agrees with NEVD that under its interconnection agreement with Bell Atlantic and under federal law the parties had agreed to treat Internet traffic as local and to compensate each other for terminating this traffic.
In New England Voice and Data's case before the Rhode Island PUC, Bell Atlantic had announced its decision to withhold compensation to NEVD for calls that the competitive carrier was terminating, saying that it believed Internet traffic to be largely interstate and not local.
