interstate gas markets are regulated by the Federal Energy Regulatory Commission (FERC) pursuant to the Natural Gas Act of 1938, (75) which does not regulate the state markets.
FERC Commissioners voted on December 15 to approve the project, and FERC issued an order yesterday under Section 3 of the Natural Gas Act authorizing the project.
Specifically, the purpose stated in the Natural Gas Act (NGA) of 1938 was the Federal Power Commission's (FPC) establishment of "rates that are just and reasonable to protect the interests of utility customers, while at the same time safeguarding the rights of investors to the end that new capital will be attracted .
