Currently, a person found not criminally responsible on account of mental disorder is neither convicted nor acquitted and, as a result, is not sentenced.
Capping provisions set an outer limit or cap on the length of time a person found unfit to stand trial or found not criminally responsible on account of mental disorder may be held under criminal law authority.
