ASTA helped draft the Plant Variety Protection Act (PVPA) which would grant breeders a Certificate of Protection, giving them exclusive rights to market a new plant variety for 17 years from the date of issuance.
In the United States, the Plant Variety Protection Act was amended in 1994 to conform with international standards for plant breeders rights established by the International Union for the Protection of New Varieties of Plants (UPOV).
The issue involves crop seeds that are protected by federal patent laws and the Plant Variety Protection Act.
