The Electoral Commission said: "We have begun a formal investigation into whether there has been any failure to comply with the Political Parties, Elections and Referendums Act in connection with donations made to the Conservative Party by Bearwood Corporate Services.
But today, in his letter, Huhne said that section 61 of the Political Parties, Elections and Referendums Act 2000 (PPERA) said it was an offence to commit an act "in furtherance of any arrangement which facilitates or is likely to facilitate, whether by means of any concealment or disguise or otherwise", the payment of an illegal donation.
The Neath MP was reported to have been interviewed by police over potential breaches of the Political Parties, Elections and Referendums Act 2000 during the past few weeks, but no arrests have been made.
