Retirement funds also can be attached through qualified domestic relations orders and federal tax hens in or outside of a bankruptcy. Voit (CCH, 2004), is divided into two parts--valuing retirement benefit plans and drafting qualified domestic relations orders (QDROs) and non-Employee Retirement Income Security Act of 1974 (ERISA) plan orders. The order will not be a qualified order if it requires the plan to provide any type of payment or form of benefit or option not otherwise provided under the plan, requires the plan to increase benefits, or requires payment to someone when such payments are already required to be paid to someone else under a previously existing qualified domestic relations order. |
