Congress created two separate funds to help 9/11 attack victims: A September 11th Victim Compensation Fund of 2001, which operated from 2001 through 2003 and handled claims related to the immediate effects of the attacks, and a second fund, the September 11th Victim Compensation Fund, which started up in October 2011 and has been accepting claims for long-term attack-related health problems, and claims for the health problems suffered by the emergency workers who responded to the attacks and by the workers who helped clean up the attack debris.
FINAL REPORT OF THE SPECIAL MASTER FOR THE SEPTEMBER 11TH VICTIM COMPENSATION FUND OF 2001, at 70-72 (2004), available at http://www.
1) Title 1V of the Act created the September 11th Victim Compensation Fund of 2001 (the "Fund"), an administrative compensation scheme for those victimized by the attacks.
Congress enacted the September 11th Victim Compensation Fund of 2001 as Title IV of the Air Transportation Safety and System Stabilization Act and as part of a broad effort to, first, protect the financial viability of the airline industry by limiting air carrier liability arising from civil lawsuits to insurance coverage, and, second, by providing victims in effect no-fault insurance in which proof of liability would not be required.
Because each claim is being considered individually, there's no guarantee the approximately 20 other gay survivors who filed with the September 11th Victim Compensation Fund of 2001 will receive compensation.
