12) The court acknowledged that although it had the jurisdiction to grant a rehearing under USCIT Rule 59(a)(2), the purpose of a rehearing is not to give the plaintiff an opportunity to retry his or her case, but rather merely give the plaintiff an opportunity to correct "significant flaws in the conduct of the proceeding," and that the court would only overturn its prior decision upon finding that the decision was "manifestly erroneous. In Agro Dutch II, discussed below, the court ordered reliquidation notwithstanding that the plaintiffs, foreign producers of merchandise subject to an antidumping order, filed their motion for an injunction outside the period set forth in the USCIT Rules. Default was entered by the Office of the Clerk of the Court of International Trade pursuant to USCIT Rule 55 (a) for failure to obtain counsel in order to defend the allegations set forth in the complaint. |
