Through amendments to the Environmental Protection Act and the Ontario Water Resources Act, ministry officials would have the authority to respond within days of a spill to an environmental violation without having to go through the courts. Section 1135 of the Federal Water Resources Act, passed in 1986, gave them an opportunity to proceed. Washington's Water Resources Act of 1971 requires that "[p]erennial rivers and streams of the state shall be retained with base flows necessary to provide for preservation of wildlife, fish, scenic, aesthetic and other environmental values, and navigational values. |
