At the trial in Kosilek II, several witnesses testified to the fact that, in accordance with the SOC, SRS may be the only adequate treatment for
GID. (132) While some doctors consistently suggested that the surgery was medically necessary, DOC personnel testified that "the safety and security concerns presented by the prospect of undertaking sex reassignment surgery for Michelle Kosilek [were] insurmountable," and thus DOC officials denied Kosilek the procedure.
Now, I'm not interested here and now in arguing about the validity of biologically determined
GID (BDGID); for argument's sake, let's assume it is a real phenomenon.
The ADA should play a prominent role in this project because the ADA's
GID exclusion is the moral case against transgender people.
Finally, one of the most important issues an agency will have to consider about transgender youths is the role that a diagnosis of
GID will play in the decisions the agency makes with regard to a youth; will a youth who selfidentifies as transgender who is not diagnosed with
GID receive different treatment (medical or otherwise)?
