With regard to the Temporary Agency Work Directive, reactions are milder at the political level, even if the social partners remain just as divided.
"We have never been so close to an agreement." Only two points still have to be settled, as summed up during the public debate by Luxembourg's Minister Francois Biltgen: "The waiting period during which equal treatment applies for the Temporary Agency Work Directive, and the framework for the opt-out from the Working Time Directive".
On the one hand, the 'social lovers' (Belgium, Cyprus, Spain, France, Italy, Greece, Hungary, Luxembourg, Romania, Sweden, etc) have made concessions and are willing to accept the indefinite nature of the opt-out in exchange for a framework being established and for agreement on the Temporary Agency Work Directive. As Hungarian Minister Gabor Csizmar said, "the opt-out has to remain an exception that must be limited in time or to only one sector of the labour market".
After approving a whole series of conclusions - flexicurity (see Europolitics 3423), employment guidelines (3423), social inclusion (3428), women and poverty (3414), gender equality (3427), assessment of the European Year of Equal Opportunities (3423) - and debating social services of general interest and the Commission's latest communication (3417), the Employment and Social Policy Council discussed the major subject of the day over lunch, namely the Working Time and Temporary Agency Work Directives. Three elements quickly emerged from their talks.
Meanwhile, the Presidency will also aim to move forward the stalled negotiations on the Temporary Agency Work Directive. Drawing on a new proposal by the Commission, the Directive would aim to improve the position of temporary agency workers in Europe.
