The problem is that if you pick up a statute book and read section 111(d), it says the EPA cannot use the section to regulate any plants that are already regulated under the agency's air toxics program. Mercury emissions from existing coal-fired power plants are already regulated under the air toxics program, so--as the EPA has acknowledged--a "literal reading" of section 111(d) would effectively prohibit the agency from issuing its Clean Power Plan in any form.
The agency could use section 111(d) to regulate carbon dioxide (a non-toxic pollutant) from other types of sources that are not subject to the air toxics program (of which there are many).
Recommendations included clearly defining the key priorities of the Clean Air Act air toxics program to identify the most effective approaches for HAPs benefits analysis, focusing on susceptible and vulnerable populations, and improving dose-response estimation for quantification of benefits.
A concern with this approach is that some will assume that benefits are negligible rather than unquantifiable, and therefore the value of the air toxics program and its regulations may be underestimated.
In this context, GAO was asked to assess (1) EPA's progress and challenges in implementing the air toxics program, (2) available information on the program's costs and benefits, and (3) practices of state and local air toxics programs.
While EPA has made some progress in implementing its air toxics program mandated by the 1990 Clean Air Act Amendments, most of its regulatory actions were completed late and major aspects of the program have still not been addressed.
To examine whether this informal activity may also have an effect on emissions, column 3 includes a variable to indicate the presence of any air toxics program. A small negative coefficient is estimated for this variable.
The coefficients on other characteristics of the air toxics program remain approximately the same with the inclusion of this variable.
7 The data derive from detailed descriptions of air toxics programs in response to a survey by the State and Territorial Air Pollution Program Administrator (STAPPA 1989).
The shutdowns haven't hit the industry too hard, says Richard Rumba, the air toxics program manager at the state's Department of Environmental Services.
