Meanwhile, work on the EU's Capital Adequacy Directive is continuing behind the scenes, with a third consultative paper drawing many thousands of pages of responses in October.
The rulebook would detail day-to-day application of the Capital Adequacy Directive.
The plan to update the 1988 EU Capital Adequacy Directive is part of a wider overhaul of financial services legislation under the Commission's 1999 Financial Services Action Plan.
His comments come as the European Commission considers the results of a recent consultation on amending the Capital Adequacy Directive (see European Report 2777).
This comprises the settlement finality Directive (98/26/EC), the Capital Adequacy Directive (93/6/EEC, 98/31/EC, and 98/33/EC) and the Investment Services Directive (93/22/EEC), which is currently undergoing revision.
The Commission intends to make a working document available in late October, and a final consultative document in early Summer 2003, to be followed by a proposal for a Directive in early 2004 to amend the existing Capital Adequacy Directive (1993/6/EEC).
When voting on the proposed updating of the 1988 EU Capital Adequacy Directive in mid-November, the Parliament said it was ready to look at how current procedures could be streamlined relating to important Basle Committee recommendations on reserve requirements that banks needed to cover low-risk loans - an important step which MEPs have hailed as the right move to stop EU banks losing out to foreign rivals whose governments are able to rapidly adopt new legislation (see European Report No 2546).
After the Commission updates the 1988 Capital Adequacy Directive to reflect the recommendations of the Basle Committee of international banking experts, EU banks would be required to only retain a meagre 10% of their original 8% reserve on lower-risk loans.--The report adopted by the European Parliament on 17 November summarises the rapporteur's call for urgent attention to the Basle Committee recommendations.
This Spring, the Commission is expected to propose amending the EU's 1988 Capital Adequacy Directive to introduce changes on three fronts: minimum capital requirements on fine-tuned 1988 rules; individual review of a credit institution's capital adequacy by supervisory authorities; and effective use of market discipline as a lever to strengthen disclosure and encourage sound banking practices.--Risk weighting. The European Mortgage Federation has expressed surprise at the Basle Committee's proposal to grant an identical rating of 100% to mortgage credit given for commercial purposes as those for unsecured loans, even though the lender has a claim on the property in the event of insolvency.
In Europe new EU capital adequacy directives could mean that more capital will have to be employed in fund management businesses.
