There are groups out there that help communities organize and face the threat of a CAFO or CAO (Concentrated Animal Operation).
Specific recommendations included initiating "steps necessary to tighten" the sections of the regulations dealing with requirements on the importer of manure from a concentrated animal operation. The committee also recommended the State Conservation Commission consider written agreements among producers, haulers, brokers and importers of manure, and at a minimum require nutrient balance sheets on importing farms.
In 2002, the State Conservation Commission, the 11-member government body responsible for implementing and enforcing the Nutrient Management Act, began its required five-year review of the density-based criteria for defining a concentrated animal operation. Commission members include the secretary of the Pennsylvania Department of Agriculture, the secretary of the Pennsylvania Department of Environmental Protection, the dean of Penn State University's College of Agricultural Sciences, four active farmers and two non-farmer members.
At present, a concentrated animal operation may export manure off the farm to a known landowner, a broker, or an open market system as part of the nutrient management plan.
Pennsylvania's 1993 nutrient management legislation called specifically for the definition of concentrated animal operation, those operations required to implement a state approved nutrient management plan, to be reviewed after five years of program implementation.
The regulations require concentrated animal operations, operations with more than 2,000 pounds of live weight on an annualized basis per acre available to spread manure, to develop and implement a state-approved nutrient management plan (Beegle and Lanyon, 1994b).
(Such farms are called concentrated animal operations. An AEU is 1,000 pounds of live weight of livestock or poultry animals.
In the final regulations, which take effect in October of 1997, concentrated animal operations (CAOs) must obtain a nutrient management plan developed by a Certified Nutrient Management Specialist.
The Act states that "concentrated animal operations" will be required to develop and maintain a nutrient management plan.
