Factory Mutual offers a coverage they call Contingent Time Element Extended (CTEE).
The policy defines "contingent property" to include "property from which you or others on your account receive the delivery of manufactured materials or services if those materials or services are essential for the continuation of your business activities." The policy also had an endorsement to provide a $70 million sublimit of insurance for contingent time element from the Chalk River reactor as a supplier to Lantheus.
To help mitigate this risk, many property policies include contingent time element or contingent business interruption endorsements that specify what areas of a company's supply chain it will cover i.e.
Contingent time element claims require information from and communication with suppliers and/or customers and often with indirect suppliers and/or customers.
The District Court for the Southern District of New York had capped ABM's recovery of loss of income at the $10,000,000 sublimit for contingent time element. The appellate court's ruling will permit ABM to argue that it has business income coverage for losses totaling more than $100,000,000.
At issue was whether ABM's loss of income from destruction of the buildings was covered as business interruption, loss from property "used" or "controlled" by ABM, or as contingent time element (contingent business interruption), loss from property "not operated" by ABM but, rather, by ABM's customers.

Considering the aviation disruption due to the volcanic eruption in Iceland, the predicted volatility of weather patterns due to global warming, and the overall high risk volatility of the transportation industry it would stand to reason that risk managers with long and complex supply chain exposures would find it worthwhile to discuss their non-traditional exposures with professionals experienced in quantifying and mitigating these risks as contingent time element and non-physical damage claims are often the most difficult to quantify and substantiate with documentation.
