We should therefore recognise that there has been no judgement on the merit of the case regarding the appropriateness of Japan's own EFP (experimental fishing program).(7) This statement reiterated Japan's position that the dispute must be handled within the Commission.
(5.) Ministry of Foreign Affairs (Japan), `Statement by Foreign Minister Masahiko Koumura on the International Tribunal for the Law of the Sea's Order on the Request for Provisional Measures concerning Japan's Experimental Fishing Program on Southern Bluefin Tuna', 27 Aug 1999.
Tuckey said a dispute remained between the two countries over 711 tons of the fish that Japan claims it is legally entitled to after it ''paid back'' fish caught out-of-quota during the 1999 experimental fishing program.
Japan's decision to commence a unilateral experimental fishing program in 1998, to continue until 2001 with an annual catch of up to 2000 t., followed three years of failed negotiations within the Commission to establish a joint research program.
Japan has temporarily suspended its experimental fishing program as ordered by the International Tribunal for the Law of the Sea, but has not abandoned either the experimental program or its requests under the commission for a much higher quota in the future.
Relations within the CCSBT deteriorated even further when Japan unilaterally undertook an experimental fishing program, which was this year expected to net 2,000 tons above quota.
Boyd said it was unclear whether Australia and New Zealand would be successful in forcing Japan to halt the program, as this area of law was largely untested, but immediate cessation was an important goal and could stop future experimental fishing programs. "The value of cessation to the health and integrity to the species is questionable, but it's better to stop at some point than not at all," she said.
The two countries are currently involved in a formal dispute resolution process under the CCSBT following Australian opposition to an experimental fishing program -- begun by Japan in July and ended Aug.
Parer said the Australian government had informed Tokyo that its experimental fishing program placed it in breach of several of its obligations under international law, including the U.N.
Talks under the CCSBT broke down earlier this year when Australia and New Zealand rejected Japan's request for an increased quota for 1998, as well as an additional catch of 1,400 tons under the experimental fishing program.
