But the FSSAI has now approached the Supreme Court challenging the High Court order on several counts, but primarily maintaining that Maggi noodles samples chosen at random by an independent body should have been tested in laboratories, and not those provided by Nestle.
The FSSAI petition says the Bombay High Court erred by asking Nestle itself, rather than a neutral authority, to provide the fresh Maggi samples for testing at the government laboratories, the newspaper reported.
"As part of the efforts to resolve the Maggi noodles issue, Nestle India has today approached the Bombay High Court raising issues of interpretation of the Food Safety and Standards Act 2011 while seeking a judicial review of the order dated June 6, 2015, passed by the Food and Drug Administration (FDA) in Maharashtra and the order dated June 5 passed by FSSAI. At the same time, we are continuing withdrawal of Maggi noodle products.
While reserving the right to prosecute, the FSSAI issued a series of orders to Nestle, including withdrawing nine versions of its Maggi instant noodles and another product that was being sold without product approval.
