In order to remedy some of its concerns about the viability of the HCOC, the Council of the EU announced December 18, 2008, that the EU would undertake several projects to increase the number of states subscribing to the Code, support implementation of the Code among subscribing states, and provide "further enhancement of the Code." Implementation of these projects, which will take an estimated two years, according to the EU, was to begin after the conclusion of a financing agreement with the French Fondation de la Recherche Strategique, which will be responsible for technical implementation.
The proceeds of the financing will be used to repay existing bank debt and redeem existing senior subordinated notes of HCOC, as well as to fund general corporate purposes.
