Adoptions from Vietnam, however, are expected to resume when the country ratifies the
Hague Convention on Intercountry Adoptions in January.
This is due to the implementation of the
Hague Convention on Intercountry Adoption (HCICA).
The judgment in this case makes no reference to the
Hague Convention on Intercountry Adoption but in cases to which the Convention applies, it is likely that additional requirements will need to be satisfied before any agreement under the Convention between the central authorities of the relevant states can be achieved.
Faced with disruption of its lucrative baby-adoption industry, Guatemala has ratified the
Hague Convention on Intercountry Adoption. Under the terms of the convention, the government must regulate adoptions to ensure that babies have not been bought or stolen.
