Under Section 36(b) of the Arms Export Control Act, Congress must be formally notified 30 calendar days before the Administration can take the final steps to conclude a government-to-government foreign military sale of major defense equipment valued at $14 million or more, defense articles or services valued at $50 million or more, or design and construction services valued at $200 million or more.
Commercially licensed arms sales also must be formally notified to Congress 30 calendar-days before the export license is issued if they involve the sale of major defense equipment valued at $14 million or more, or defense articles or services valued at $50 million or more (Section 36(c) AECA).
$685 million is the total estimated cost of Major Defense Equipment (MDE).
* The President shall not enter into any commitment of funds appropriated for Section 23, AECA, purposes for the provision of major defense equipment, other conventional ammunition, or other major defense items defined to be aircraft, ships, missiles, or combat vehicles, not previously justified to Congress or twenty percent in excess of the quantities justified to Congress unless the Committees on Appropriations are notified fifteen days in advance of such commitment.
Many of the programs focus on providing major defense equipment as well as follow-on support of tracked and wheeled vehicles, Apache and Black Hawk helicopters, weapons and smaller items purchased through FMS.
Consider up front the need for Congressional notification (required for all programs involving foreign manufacture of Significant Military Equipment; also must consider dollar value thresholds applicable to Major Defense Equipment and all other defense articles and defense services).
