Existing mechanisms - the International Convention on Civil Liability for Oil Pollution (CLC) and the OPCF - have reached their limits, argued successively Corine Lepage (ALDE, France) for the ENVI committee, Gesine Meissner (ALDE, Germany) for TRAN and Alain Cadec (EPP, France) for PECH.
On existing international agreements, they ask first whether it is considering encouraging a revision of the CLC and OPCF, such that these texts can recognise purely environmental damage, and second, whether it is considering promoting the simplification of OPCF compensation procedures.
Addressing the committees, Transport Commissioner Siim Kallas referred to the existing instruments (CLC and OPCF) and explained that, at this stage, there is no possibility to seek additional compensation.

The Supplementary Fund Protocol is incorporated into the OPCF Act, via the amendments made in the 2008 Amendment Act, as directly as possible without actually incorporating the Protocol itself, or including it as a Schedule or Annex.
Importantly, s 46A provides that the 'purpose of the Supplementary Fund is to provide compensation to a person who has established a claim for compensation for certain oil pollution damage and who has not been able to obtain full and adequate compensation for the claim from the 1992 Fund, because the damage does or may exceed the compensation limits for that Fund.' This compensation regime is then largely incorporated directly into the OPCF Act, (103) with only some adjustment to allow for cross vesting of jurisdiction between Federal and State and Territory Supreme Courts.
