"While OGC's intention throughout the process of drafting the letter was to shield NCUA from potential liability, it did not advance that goal at the expense of attempting to mislead affected PSFCU
members, the California OAG or the California public," the report said.
"However, contrary to plaintiff's expectations, defendant PSFCU engaged in unlawful racial, ancestral and ethnic employee hiring and retention practices," he charged.
Mielczarek's complaint also included email from other PSFCU executives to the board challenging the hiring policy and warning the board that it was in violation of federal law.
The credit union has not yet filed any response to the complaint, but PSFCU issued a statement through attorney Dena Epstein of Jackson Lewis LLP in Morristown, N.J., reading, "The Polish & Slavic Federal Credit Union is an equal opportunity employer, which prohibits any and all forms of discrimination in its workplace.
The Chicago expansion is the PSFCU
's latest salvo in its development program that has enabled the $1.3 billion credit union and attract nearly 70,000 members.
Bukowski said he and other members started the committee when it became clear, in their eyes, that the PSFCU Board had begun to behave in ways they considered irresponsible.
He also charged that fliers PSFCU tellers distribute advertised only the names and pictures of the credit union board-backed candidates and suggested that credit union members who voted for those candidates would be eligible for a prize.
"As represented by PSFCU's counsel this is at least the third time a minority member of the PSFCU Board has been removed or threatened to be removed by the remaining board members," he wrote in his Sept.
"Until this matter is appropriately resolved, I intend to consider the board's conduct in this matter in connection with any supervisory activities involving PSFCU, including any requests for approval or forbearance by PSFCU," LaCreta said in a letter dated Sept.
The chair will promote cultural and scientific achievements of Poland and the Polish people at one of the most prestigious universities in the U.S., PSFCU said.
PSFCU sees this as a vital investment in the education of a younger generation of Poles who will now be able to have a greater respect and knowledge of their heritage and culture.
