The 1990 Schengen Implementing Convention might need to be amended to reflect the changes that the EAW will bring, the report says, but adds that it is too early to examine this question.
This was because it is considered an extension of the Schengen body of law, specifically Articles 54 to 58 of the 1990 Schengen Implementing Convention. According to a Council source, there was no agreement on whether to extend the allowable exceptions to the rule to include other "equally essential state interests".
This draft Framework Decision would replace Articles 54 to 58 of the 1990 Schengen Implementing Convention, which further expands on the principle.
The latter type will probably be slated, with Ministers vowing to enshrine the right to demonstrate peacefully.As regards EU-wide measures to boost security, it would be virtually unprecedented but there are legal possibilities, such as articles 22-26 of the 1990 Schengen Implementing Convention. For example, a Member States can put out an alert on a legal resident of another Member State and ask the latter to withdraw the residence permit.
It also contains a statute for victims of the trade and provisions on the prevention of trafficking.The Commission is satisfied that these Protocols are compatible with EU rules and principles such as, for example, Article 26 of the 1990 Schengen Implementing Convention. The latter provides for sanctions against carriers failing to verify the travel and identity documents of their passengers.
The one exception is the provisions on cross-border surveillance (Article 40 of the Schengen Implementing Convention).
