They address issues related to the identification of students with disabilities, particularly learning disabilities and emotional and behavioral disorders; problems with the evaluation process that negatively influence diagnosis, including the disproportionate representation of students from low socioeconomic backgrounds and students of color, and the evaluation of bilingual students; and issues with service provision in terms of Individualized Education Programs, specially designed instruction, and alignment with grade-level curriculum and standards, as well as response to intervention.
As a part of FAPE, school districts are sometimes required to provide specially designed instruction and/or related services to students outside of regular school days and hours.
Special education is a service that provides specially designed instruction. Specifically, IDEA states that special education is "specially designed instruction, at no cost to the parents, to meet the unique needs of a child with a disability" ([section]300.26).

Her accommodations, such as the PE waiver and the hybrid school/home schedule, do not seem to constitute specially designed instruction. Overidentification under the IDEA, particularly for certain classifications, such as Other Health Impairment, is a recognized problem in various parts of the country, depending in part on local wealth and state funding formulas.7 As for the possible alternative of Section 504, in certain locales, including Blair's,8 districts are similarly less than rigorous in applying the required elements for eligibility under this statute.9
First, IDEA added a definition of supplementary aids and services and specially designed instruction. Supplementary aids and services are defined as "aids, services, and other supports that are provided in regular education classes or other education-related settings to enable children with disabilities to be educated with nondisabled children to the maximum extent appropriate" (Assistance to states for the education of children with disabilities program and preschool grants, 1999).
Yet, data support the contention that IEPs are not functioning as designed, including being inept at structuring "specially designed instruction."
Special education is specially designed instruction provided to meet unique needs of children with special needs, ages 3 through 21.
Results of a recent study by Jenkins and Leicester (1990) suggest that classroom teachers will need assistance in developing and implementing specially designed instruction for low achieving students.
* A representative of the school district who is: qualified to provide, or supervise the provision of, specially designed instruction; is knowledgeable about the general education curriculum; and is knowledgeable about the availability of the school district's resources;
