In 2006, South Africa became the first country in Africa to recognise same-sex marriages when the Civil Union Act was passed by Parliament.
However, the Appellate Court concluded that the trial court should have granted the Defendant's request that it apply "principals of comity to the civil union and thereby recognize that both parties have rights with respect to property acquired during the civil union." The court pointed to the New York Court of Appeals Decision in Brooke S.B.
"I am glad to inform you that on October 8 I will celebrate a civil union," she wrote in the document seen by the Thomson Reuters Foundation.
AS OF JUNE 1, residents of the Land of Lincoln are free to enter into civil unions, which allow same-sex couples to enjoy the benefits, protections, and responsibilities under Illinois law that are granted to spouses.
Two law professors from Pepperdine University, a Christian college in Malibu, California, have argued that this is just the legal adjustment needed to resolve the contradiction created by Proposition 8 in California, which overturned "marriage" for same-sex couples while preserving civil unions. Professors Douglas W.Kmiec and Shelley Ross Saxer, "dear friends" and colleagues for a decade, found themselves on opposite sides in the 2008 referendum, with Kmiec voting "yes" and Saxer voting "no." In a San Francisco Chronicle op-ed piece, Kmiec and Saxer argued that the California high court could uphold Prop 8 and the vote of the people, inserting into the state's constitution a definition of marriage as limited to a man and a woman.
Therefore, he said, "we (insurers) have to say we issue contracts within the federal tax code, and unfortunately, we cannot recognize civil union partners for purposes of spousal continuation."
The two laws set up a powerful potential conflict: DOMA allows a state to reject a civil union formed in another state, while the PKPA requires a state court to refuse to grant a new custody order when one has already been issued by another state.
In 2005, a bill that would have allowed civil unions and barred discrimination passed the Democratic-controlled Senate but never got a hearing in the House.
The civil union law was passed December 14 and went into effect February 19.
PRINCETON, NJ -- As former New York City mayor Rudy Giuliani inches closer to a formal declaration of his candidacy for the 2008 Republican nomination for president, the challenge he faces among Republicans with his support of abortion rights and same-sex civil unions is clear in a recent USA Today/Gallup Poll.
Mello describes these processes in his analysis of civil unions by first describing the court's decision on same-sex marriage, by cataloguing some of the publicly expressed hatred that followed the decision, by delineating the court's role in protecting the interests of minorities, and by noting the political and the cultural climate in which these events took place.
But Sir Elton's civil union has polite society scratching its head over what title partner David Furnish will take.
