25) After applying rules of statutory interpretation, the United States Courts of Appeals for the Fifth and Eighth Circuits and their progeny of cases have concluded that "send" in Article 10(a) only provides a method of sending succeeding documents after service of process has been completed because the terms "serve," "service," and "to effect service" are used in subsections (b) and (c) of Article 10 and other articles; but was not included in subsection (a) by inference, showing the drafters acted intentionally in omitting the term.
These cases, therefore, state that a defendant that ignores faulty service of process might be found to have waived one component of personal jurisdiction: the defense of improper service of process.
Accordingly, the fact that service of process is allowed in order to initiate the actions permitted by the express exceptions to inviolability does not mean that service of process on a diplomat is otherwise permissible under Article 29.
Editor's Note: Most states require that unless there is "just cause "for failing to make service of process on a defendant or defendants, due to the fact that they cannot be located or other reasonable cause, service of process must be completed by the time set forth in the law and/or Rules of Civil Procedure.
The Eighth Circuit, however, has held that "send" does not include the service of process but is a method for transmitting judicial documents after service has been accomplished.
Thus, when RIO presented the district court with its inability to serve an elusive international defendant, striving to evade service of process, the district court properly exercised its discretionary powers to craft alternate means of service.
